Terms of Use and Disclaimer

General educational information and the conditions for using this website and its materials.

Last updated: November 6, 2026.

1. Scope and acceptance

These terms describe conditions for accessing this website and using its articles, guides, checklists, workbooks, templates and other materials. Please review them before using or downloading materials. A link to these terms alone does not establish that every visitor has entered an enforceable agreement; applicable law governs whether and to what extent these terms bind a visitor.

2. Educational information only

The website and its resources are provided for general educational and informational purposes. They are not legal, tax, accounting, employment, immigration, benefits, insurance, safety, regulatory, financial or other professional advice, and are not a complete compliance program or substitute for professional judgment.

3. No professional relationship

Viewing the website, downloading resources or contacting Marshall Varner does not itself create a consulting, advisory, fiduciary, attorney-client, employment or other professional relationship. Any paid engagement requires a separate written agreement.

4. Your decisions and compliance responsibilities

You are responsible for evaluating whether any material is appropriate for your organization, obtaining qualified advice when needed, identifying applicable federal, state and local requirements, and independently verifying current laws, deadlines and guidance before acting. The materials are primarily US-focused; jurisdiction-specific requirements may differ.

5. Accuracy, updates and warranties

Content may contain errors, omissions or outdated information. Publication and review dates refer to the stated edition, not a promise of continuing accuracy. There is no obligation to monitor, revise or notify users of changes. To the fullest extent permitted by law, the website and materials are provided as is and as available, without express or implied warranties, including warranties of accuracy, completeness, fitness for a particular purpose or noninfringement.

6. Free internal-use license

You and your organization may download, copy, use and adapt free resources for your own internal business, nonprofit or personal operations, including internal training and implementation. Keep appropriate attribution to Marshall Varner on copies of original materials when practicable. Adaptations should be identified as your own and must not be represented as approved, certified or maintained by Marshall Varner. This limited, nonexclusive, revocable permission does not transfer ownership of any content.

7. No sale or redistribution for commercial gain

You may not sell, license for a fee, sublicense, monetize, bundle for sale, offer as paid course or subscription content, or otherwise commercially exploit any website content, downloadable material or substantial derivative of it without prior written permission. You may not publicly repost, publish, distribute or provide the materials as a standalone resource library or competing product, whether free or paid. Ordinary internal sharing with employees and service providers for your organization's own operations is permitted. This restriction does not prevent you from charging for your own independent professional services that do not sell or redistribute these materials.

8. Intellectual property and attribution

Unless otherwise indicated, original website content and resources are owned by Marshall Varner and protected by applicable intellectual property law. All rights not expressly granted are reserved. Do not remove ownership notices, falsely claim authorship, or use Marshall Varner's name, likeness, branding or materials to imply sponsorship or endorsement. Third-party names, trademarks and logos belong to their respective owners.

9. Templates, workbooks and sensitive information

Templates and workbooks are starting points, not approved policies for every employer. You are responsible for modifications, decisions and records. Do not enter employee medical information, Social Security numbers, payroll identifiers, investigation records or other sensitive personal data into unsecured workbooks or services. Use appropriate access controls, secure storage and retention practices.

10. Illustrations and independent views

Examples are illustrative and may be fictionalized. Unless expressly stated otherwise, the views and materials are independent and do not represent or disclose the policies, confidential information, or endorsements of any current or former employer, client, professional association, nonprofit or other organization.

11. External sites and services

Links to third-party websites and services are provided for convenience. Those parties control their own content, terms and privacy practices. Inclusion of a link, name or logo does not necessarily indicate endorsement, affiliation or sponsorship.

12. Limitation of liability

To the fullest extent permitted by applicable law, Marshall Varner disclaims liability for indirect, incidental, special, consequential or punitive damages, lost profits, lost data, business interruption and losses arising from use of or reliance on the website or materials. No provision excludes or limits liability that applicable law prohibits excluding or limiting. The enforceability of any limitation depends on applicable law and whether a legally binding agreement exists.

13. Website security and prohibited conduct

Do not interfere with site operations, attempt unauthorized access, distribute malicious code, scrape the site in a way that disrupts service, or misrepresent the origin or ownership of content. These terms do not restrict lawful security research or other activity protected by applicable law.

14. Privacy and technical information

This website does not require an account to access free resources. Hosting and security providers may process technical information such as IP addresses, request details, device information and logs. External font providers and third-party links may receive technical information when accessed. Contacting Marshall Varner by email or another channel discloses information you choose to send, which may be used to respond. Do not submit sensitive employee or client information through general contact channels. This summary is not a verified inventory of all hosting, analytics, cookies or retention practices; applicable privacy notices and practices must reflect the services actually configured.

15. Changes and severability

These terms may be updated, with the updated date shown on this page. Changes apply prospectively to the extent permitted by law. If any provision is unenforceable, the remaining provisions continue to the extent legally permissible.

16. Governing law

To the extent a binding agreement exists and applicable law permits, these terms are governed by the laws of Tennessee, without regard to conflict-of-law rules. Mandatory rights and protections under other applicable laws remain unaffected. No exclusive forum, arbitration requirement or class-action waiver is imposed by these terms.
